EFT was sent to Wells Fargo, I get a letter back stating that they do not accept the form of payment sent. It was sent back regular mail and no EFT instrument with the letter.
I followed ALL of the EFT directions to the T, My home went to Sheriff sale. I called the attorney to whom the sale was sent by. They did not know what a EFT was. They then postponed the sale until the 9th of November. Then I get a letter from Wells Fargo stating that the sale was moved until January 6, 2013 since they were researching the documents I sent.
On Friday November 9, 2012 I find out that my home was SOLD. I then called the law firm back and told them about the letter I got from Wells Fargo. I was asked to fax the letter since they received nothing from Wells Fargo. I was even told that they the lay firm called Wells Fargo the day before and was told to proceed with the sale.
I NEVER received any EFT unit back, no answers to any of the letters I sent to Wells Fargo, Everbank, and the Lay firm.
Also, come to find out that the law firm they use is a collection agency.
I need HELP to figure all of this out and to keep my home.

Very unfortunate situation. This forum is a growing community with helpful people. I hope that help will start poring in for you. How did you learn that the law firm was a collection agency?

I did research, The address was the same as the one I recived from Wells Fargo years ago. When I spoke to the Power Legal she Filled me in that this law firm onlys works with banks that do forclosures.

You have to comprehend that not everyone knows what is going on.
The majority of people working the system know how to do their part, for example prepare motions, memos, deeds, whatever. But if you ask them to explain how the whole process works, most people working in the system do not know how the whole process works, with the exception of the senior partners or judges. And even them have trouble explaining the system inner workings.
It is also like playing poker, there are many people working the system that will bluff you into waiving your rights and making you lose your property for their own benefit.

Wells Fargo has little idea what they are doing. They tell you one thing but do the opposite. They fail to respond when they tell you they need more time to research documents. Six months later you get another letter from the same person that says the same thing. Worker bees call their bosses liars and you get a different answer from each person you talk to regarding one's account...I'll be glad when I'm done with them.

EFT. I just went to court this morning and lost the house to a judgment. he judge tried real hard to find a way he didn't have to do the judgment. The lawyer for Bank of America was almost in tears. I tried to put it to the court I did EFT's. He said he can't rule on whether BofA HAD the right to foreclose he just sees the deed is in the trustees name and we are just squaters in their property. I objecte3d to the things he was saying and he smiled every time. I am working on a land patent to get the title back in our names I just hope I have time. I have my paper work ready to file bankruptcy 13. Ca anyone tell me how they proved the lender should except the EFT? and if the BK!# will stop the eviction? 208-280-0868 Debra Denny I have to stay in our home it is the family home. We run a business out of it. I am going to post this in many of the places on this forum hoping someone will here my plight and can shed some light on how to proceed.

If you can prove fraud in any documents then under f r c p 60d, the judgment can be set aside.
